TERMS OF USE
Notice to subscribers: You may cancel your subscription, without penalty or obligation, at any time prior to midnight of the day following the date you subscribed to the free trial.
After this free trial ends, your subscription will auto-renew at the price of the subscription type you selected.
- Auto-renewable subscription
- 1 month ($9.99), 1 year ($8.33 a month, $99.99 total), 3 year ($6 a month, $249.99 total) durations. The annual and three-yearly subscriptions will be billed in one charge upfront, not monthly. No refunds will be issued for change of mind.
- Your subscription will be charged to you at the end of the free trial period and will automatically renew (at the duration selected) unless auto-renew is turned off at least 24 hours before the end of the current period.
- Current subscription may not be cancelled during the active subscription period; however, you can manage your subscription and/or turn off auto-subscription. We look forward to joining you on this journey and helping you reduce the stress in communicating with your co-parent.
INTRODUCTION
(a) These terms and conditions (Terms) apply when you use the CoOperate mobile app or CoOperate app (CoOperate app).
(b) You agree to be bound by these Terms which form a binding contractual agreement between you and us, The Co-parenting Institute Pty Ltd.
(c) If you don’t agree to these Terms, you must refrain from using the CoOperate app.
(d) We may change these Terms at any time by updating this page of the CoOperate app, and your continued use of the CoOperate app following such an update will represent an agreement by you to be bound by the Terms as amended.
ACCESS AND USE
You must only use the app in accordance with these Terms and any applicable laws, and must ensure that your agents who use or access the app comply with the Terms and any applicable laws.
YOUR OBLIGATIONS
You must not:
- (a) copy, mirror, reproduce, translate, adapt, vary, modify, sell, decipher or decompile any part or aspect of the CoOperate app without the express consent of the Company;
- (b) use the CoOperate app for any purpose other than its intended purpose;
- (c) use, or attempt to use, the CoOperate app in a manner that is illegal or fraudulent or facilitates illegal or fraudulent activity;
- (d) use, or attempt to use, the CoOperate app in a manner that may interfere with, disrupt or create undue burden on the app or the servers or networks that host the app;
- (e) use the app with the assistance of any automated scripting tool or software;
- (f) act in a way that may diminish or adversely impact the reputation of the Company, including by linking to the CoOperate app on any other CoOperate app;
- (g) attempt to breach the security of the CoOperate app, or otherwise interfere with the normal functions of the app, including by:
- (i) gaining unauthorised access to app accounts or data;
- (ii) scanning, probing or testing the app for security vulnerabilities;
- (iii) overloading, flooding, mailbombing, crashing or submitting a virus to the app;
- (iv) or instigating or participating in a denial-of-service attack against the app.
INFORMATION ON THE COOPERATE APP
While we make every effort to ensure that the information on the CoOperate app is as up-to-date and accurate as possible, you acknowledge and agree that we do not (to the maximum extent permitted by law) guarantee that:
- (a) the CoOperate app will be free from errors or defects;
- (b) the CoOperate app will be accessible at all times;
- (c) messages sent through the CoOperate app will be delivered promptly, or delivered at all;
- (d) information you receive or supply through the CoOperate app will be secure or confidential; or
- (e) any information provided through the CoOperate app is accurate or true.
We reserve the right to change any information or functionality on the CoOperate app by updating the CoOperate app at any time without notice, including product descriptions, prices and other CoOperate app Content.
INTELLECTUAL PROPERTY
(a) The Company retains ownership of the CoOperate app and all materials on the CoOperate app (including text, graphics, logos, design, icons, images, sound and video recordings, pricing, downloads and software) (CoOperate app Content) and reserves all rights in any intellectual property rights owned or licensed by it not expressly granted to you.
(b) You may make a temporary electronic copy of all or part of the CoOperate app for the sole purpose of viewing it. You must not otherwise reproduce, transmit, adapt, distribute, sell, modify or publish the CoOperate app or any CoOperate app Content without prior written consent from the Company or as permitted by law.
SECURITY
The Company does not accept responsibility for loss or damage to computer systems, mobile phones or other electronic devices arising in connection with use of the CoOperate app. You should take your own precautions to ensure that the process that you employ for accessing the CoOperate app does not expose you to risk of viruses, malicious computer code or other forms of interference.
REPORTING MISUSE
If you become aware of misuse of the CoOperate app by any person, any errors in the material on the CoOperate app or any difficulty in accessing or using the CoOperate app, please contact us immediately using the contact details or form provided on our CoOperate app.
PRIVACY
You agree to be bound by our Privacy Policy, which can be found here.
LIABILITY
We make no warranties or representations about this CoOperate app or any of its content and will not be responsible to you or any third party for any direct or consequential loss suffered in connection with the use of this CoOperate app. To the maximum extent permitted by law, we exclude any liability that may arise due to your use of our CoOperate app and/or the information or materials contained on it. You agree to indemnify us for any loss or liability arising out of your use of this CoOperate app.
